3.4  Potential for Juvenile Court Referral

When appropriate, the plan should identify what the response of the Division will be if the family refuses, or is unable, to accomplish the goals in the Written Service Agreement.  The consequences should be discussed during the negotiation of the plan.  This information is particularly important if the case was opened due to a "Preponderance of Evidence" CA/N determination.  Out-of-home placement may be necessary because the risk of harm is assessed as high, or because of previous court involvement.   It may be necessary to conduct a safety reassessment and to employ safety interventions address immediate safety needs.
